1. ACCEPTANCE OF TERMS

By accessing and using Egg Drop Panic (the "Game"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Game.

2. DESCRIPTION OF SERVICE

Egg Drop Panic provides users with access to an HTML5 arcade game (the "Service"). You understand and agree that the Service is provided "AS-IS" and that we assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user content, communications or personalization settings.

3. USER CONDUCT

You agree to use the Game only for lawful purposes. You agree not to:

• Use the Game for any unlawful purpose or in violation of any applicable regulations;
• Attempt to decompile or reverse engineer any software contained on the Game;
• Remove any copyright or other proprietary notations from the materials;
• Transfer the materials to another person or "mirror" the materials on any other server;
• Attempt to bypass any measures of the Game designed to prevent or restrict access to the Game, or any portion of the Game;
• Harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent.

4. INTELLECTUAL PROPERTY RIGHTS

The Game and its original content, features, and functionality are and will remain the exclusive property of Egg Drop Panic and its licensors. The Game is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent.

5. USER CONTENT

You retain any and all of your rights to any content you submit, post or display on or through the Game and you are responsible for protecting those rights. We take no responsibility and assume no liability for content you or any third party posts on or through the Game.

6. LIMITATION OF LIABILITY

In no event shall Egg Drop Panic, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Game; (ii) any conduct or content of any third party on the Game; (iii) any content obtained from the Game; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. DISCLAIMER

Your use of the Game is at your sole risk. The Game is provided on an "AS IS" and "AS AVAILABLE" basis. The Game is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

8. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Game after those revisions become effective, you agree to be bound by the revised terms.
